It is possible for a defendant to be released before seeing a judge, because most criminal offenses have a base bail associated. Bail bonds can usually be secured for only ten percent of the bail amount and a small fee added by the bondsman. Waiting to see a judge before posting bail will not necessarily make bail more affordable, and could in fact make it more expensive or even impossible. Bail bonds make it possible for people to be out of jail and with their families before a trial is held and, if convicted, sentencing is imposed.
